We process personal information to enable us manage children and young people subject to an offending prevention programme as part of either a voluntary arrangement or a statutory order.

We also process personal information to maintain staff and volunteers' information records.

Our processing shall be lawful because at least one of the following will apply:

a) processing is necessary for compliance with a legal obligation to which the Council is subject; Data Protection Act 2018, Criminal Justice Acts 2003 & 2015, Crime & Disorder Act 1998, Legal Aid Sentencing & Punishment of Offenders Act, Bail Act 2017, Sex Offences Act 2003, Children Act 1989 and 2004, & Working Together 2015.

b) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council;

Our processing shall be lawful because processing is necessary for reasons of substantial public interest.

Where necessary or required we share information with:

• The Youth Justice Board
• Police forces
• Local and central government
• Ombudsmen and regulatory authorities
• Healthcare, social and welfare advisers
• Voluntary and charitable organisations
• Family, associates and representatives of the person whose personal data we are processing.

Wiltshire YOT will process your personal data for the above purposes for no longer than necessary. However, due to the provisions of the 'Goddard Enquiry' into historic child sexual abuse, we are not currently deleting any record.

Your rights are set out in the current Data Protection legislation and include:

• The right to access your personal information, to request rectification or erasure of certain personal information and to object to processing in certain circumstances
• The right to withdraw any consent you may have given to process your personal information
• The right to complain to the Information Commissioner (opens new window) if you feel we are processing your personal information unlawfully
• The right to restrict processing activity in certain circumstances
• The right to object to certain types of processing activity.

You are not obliged to provide this or any information.

Failure to provide us with the information however may result in a return to court, a report to police, or failure to receive the appropriate support and intervention.

Wiltshire Youth offending Team (YOT) considers the privacy of its users and appropriate data protection to be a very important issue. Wiltshire YOT complies with the data principles contained in the current Data Protection legislation.

This policy covers how Wiltshire YOT collects, receives, and processes personal information relating to service users and staff (including staff volunteers).

Personal information is information which is specific to service users and staff which enables them to be personally identified e.g. name, address, phone number, email address, gender, race, ethnicity, sexuality, and disability status etc.

This Privacy Notice does not apply to the practices of companies and organisations that the YOT does not own or control; or to people that the YOT do not directly employ or manage.

We also process personal information to enable us to manage, direct, and support employed staff and staff volunteers.

We will share personal data where necessary and lawful, but we will not share personal data with third parties unless we are required to or permitted to by law.

For Service Users (young people and their parents/carers), where necessary or required we share information with:

• The Youth Justice Board
• Police forces
• Local and central government
• Ombudsmen and regulatory authorities
• Healthcare, social and welfare advisers
• Voluntary and charitable organisations
• Family, associates and representatives of the person whose personal data we are processing

Where there is a legal reason to do so, Wiltshire YOT will also share staff personal information with Wiltshire Council as the host employer of YOT staff.

We do not and will not send marketing material or marketing information.
